Obama plans to "crack down" on music piracy
http://www.dailytech.com/article.aspx?newsid=18815 Obama Administration Announces Massive Piracy Crackdown
It also implements an interesting provision called "imminent infringement", which allows the government to charge people who they think might be about to infringe with a civil offense (for example if you searched "torrent daft punk". This is among the first official "thought crime" provisions to be proposed by the U.S. government. The bill also makes it a criminal offense to bypass DRM.
The country needs copy-right reform, not stricter regulations on it. This is fucking retarded, Obama.

Retarded to you, not to him. He's obviously trying to grab on to big campaign donations from MPAA and RIAA for his reelection year.
“A meritocratic society is one in which inequalities of wealth and social position solely reflect the unequal distribution of merit or skills amongst human beings, or are based upon factors beyond human control, for example luck or chance. Such a society is socially just because individuals are judged not by their gender, the colour of their skin or their religion, but according to their talents and willingness to work, or on what Martin Luther King called 'the content of their character'. By extension, social equality is unjust because it treats unequal individuals equally.” "Political Ideologies" by Andrew Heywood (2003)
Smash and grab? Nonsense. Nobody should say that thievery is easy. Some obscure stuff requires real skill to get and days of work, you know, searching multiple sharing networks, and anyway eventually it's often best to try uncle Google to find some private blog that uploads to Rapidshare. In that case it's of course better to conceal your IP through anonymous proxy switch. Anyway, you've got to switch it back later, because these proxies AFAIK don't support javascript, therefore no Rapidshare countdown.
In my opinion, the programs that randomly choose proxies all around the world every few seconds are a nice choice to shut the door from nosy government. I know one like this and it's paid, I'll have to see if there's an... alternative
American economy is dead or exported abroad, so people seek to make money from nothing, like from speculation and copyright laws. So yeah, piracy can destroy economy, if the economy is as fucked up as american. And this will not be fixed by catching pirates, because pirates won't buy the stuff anyway.
And yeah, what Obama administration plans is not only thought crime, but it's literally a threat to nation, if all nation does something and it's regarded as crime, then anybody can be punished anytime. Sometimes a "crime" is so widespread, that it becomes normal and eventually becomes legalized. This was the case with plentiful bribes to administration officers, the bribes are now legalized as administrative fees. It's like a change in morality. I'm not sure how small creatives are going to survive this, though. Big companies will either survive or we'll be spared of their mainstream product of consumer culture. But independent creative people or groups have lesser budgets and more artistic talent, they deserve the support.

Considering he just held a press conference and stated flatly that he wants Russia to be part of the World Trade Organization, I find this a little hard to believe. The main reason Russia is not already in the World Trade Organization is because they refuse to shut down the Russian mp3 download sites like AllofMP3 that sell cd-quality content for a fraction of what iTunes charges. Of course ... they don't pay royalties to the artists ...
Just buy the damn music/movies/games you cheap skates.
They can have my torrents when they pry them from my cold dead hands.
Careful- your inner right-winger is flaring up again.

Unless stealing from video shops is ethical.
Personally I find these hard headed laws that try to intimidate people into not doing thigs are both immoral and ineffective. Downloading music is so wide spread that almost everyone is a criminal and only a very small percentage of them could possibly be caught. This only creates parinoia where you never know who is be arrested. It could be your friends, family, your boss, yourself. It just leads to insecurity and if find that to be one of the more painful feelings to have to live with.
Well, I can see that both of you buy into the lies that are being spread around by the content industry.
Homework for either of you is to find a verifiable clip anywhere on the internet of John Phillips Sousa conducting his orchestra.
Don't bother actually because you will not find one. JPS is on record multiple times refusing to conduct his orchestra when he knew or believed recording equipment to be present. There are plenty of recording of his orchestra kicking around, just none with him running the show.
His stated reason: If people could listen to music at home any time that they wanted to do so, that would spell the end of music as was then known. After all, people would no longer have to pay to attend a public performance, so why should musicians want to record if they did not get paid every time someone heard their work?
Since then, copyright law has been reformed a couple of times, yet the concept of a public performance remains in the law. That is the reason why your home videos have the legal notice at the beginning informing you that the work is only for use at home.
FSM forbid that you have some friends over to watch a movie and you asked them to pony up for the beers. Legally (in the US at least), you are causing a public performance and the producer of whatever movie is not getting his fair share of the beer money.
Actually, in the 70's, 20th century fox sued an owner of a small lunch restaurant for the train stopping crime of playing a radio in his establishment. According to them, turning on a radio in a setting where someone who does not own the radio might actually hear the music constituted an illegal public performance of a protected work. Fortunately, the Supreme Court handed Fox their ass on a silver platter over that one.
Those examples are demonstration of the sheer greed that is going on. When you say that you really ought to pay for what you hear, remember that the logic behind that is that you should not be able to buy a recording of any music or dare to play a radio without headphones lest someone get a moment of enjoyment that has not been paid for in cash.

The logic is that the artists should get due compensation.
Just because people abuse the laws to absurd degree, does not mean that we should download/steal.
I buy all my movies, music and video games. I want my music on my laptop so I signed up for i-tunes.
DON'T COPY THAT FLOPPY!
Actually copyright originated as a means of insuring that artists could be identified and punished if they printed things that were blasphemous or seditious. That isn't why I think copyright is wrong, I'm just pointing out that from its origins it was no less detrimental to society than it is today. The reason i think it's wrong is that it is tantamount to a ban on published material that is not commercially viable. So, of course you would buy the material because there isn't anything available for free because when published content loses its commercial viability instead of being placed in the public domain it is banned by copyright and you can't buy it or have it for free, and in that sense content providers are engaged in racketeering as they are creating scarcity from which they may profit.

Dead-on, Allison.
Additionally, nobody is forcing anyone to buy from the "big names" in content publishing -it is sometimes possible to get content directly from the artists without greedy publishers involved. Just a thought.

They have games so fuk'd up already, I bought one and found out you can only install it 3x and then you have to call customer support to install it any more.
I bought and paid for a fukin cd, I should be able to share it with friends. I do agree that making it available to thousands online is crossing the line though.
They are so paranoid and greedy, movies used to say that if you got caught charging anyone to see it at your house you would face a huge fine and imprisonment, lol.
Now it's hard to even share guitar tab online if they deem it to be too accurate...
Insane little "I will sue you for any fukin thing you do" world we live in.
Faith is the word but next to that snugged up closely "lie's" the want.

Allison, give me some credit. I am a working musician, so I have a clue as to the logic.
Well, I agree that you should not steal stuff. That is just wrong.
Since you do not give me credit for being aware of the situation, here is your dose of the same.
Let's say that I am playing in some bar and a producer is in the audience. He comes up to me after I am done and offers me $50,000 for my next album.
So let's go to the recording studio. That costs $300/hour. Seriously, it costs me $20 to walk down the hall. If my gear takes a few trips to move, that can cost me over $100.
Now I am standing in the studio. If I play some music that is just ducky. I still have to pay for every minute that I am in the building. If my stuff actually gets recorded, then I have to pay an additional $150/hour for the engineer. Mind you, the engineer gets paid $20/hour for his work but the owner of the studio feels that he should be enriched to the tune of $130/hour because he is some dude who deserves that much compensation.
Hell's bells but the studio owner might charge me for the engineer's time when I take a smoke break.
Now, I don't get everything right on the first take. I have to play my stuff over and over before we get a keeper. Combining the above costs, that is $450/hour for me to pretty much suck until I don't.
Is the guy who gave me the $50,000 paying for this? No, that is coming out of the $50,000. By the time that I have an album, I might actually owe him money. Mind you, if my album goes triple platinum, the producer get to keep all the money.
The logic is that he spent all of that cash to get to that point, so he should get all the cash that comes out of the deal. Basically, he gets like $50,000,000 for my album and I owe him $2,500. this is not the end of the deal. By taking his money, I have agreed to only make albums for him for the next seven years. Every time, he gets the cash and I get shit on.
Let me make the perfectly clear. You should buy your music, movies and computer games. You should not steal from musicians. Producers should not steal from musicians. If you steal music, you are not stealing from musicians, you are stealing what is already stolen content.
Also, do not even try to mention contract law. If I go with a producer and lots of people end up thinking that I am hot stuff, I will owe money for the privilege. If I distribute on youtube, the same thing may happen but I will not end up in the red over the deal.

How did George Lucas get so much money, again? No I'm not talking Indiana Jones or Episode I-III, I mean from Episode IV alone. Yeah, the flick released in 1977.
In your favor, I will fess up on the whole musicians getting shitty deals while the album publishers rake in most of the green -this isn't the first time I've read about this either. The entertainment biz has always been slanted towards the investors' side of the table. It's only natural- the kid with the biggest toys always wins, and the guy who decides what's greenlighted and what isn't, usually gets to make bargains in his favor.

My favorite is when people act like music and art being free is a new thing.
I will pay as I see fit.
I would spend the same amount of money if I didn't have access to free stuff. I just wouldn't discover as many bands/artists/actors etc.
I pay to see a play, for example, because that is a unique piece of art with a certain expiration date, that only occurred once, even though there is source material. Digital copies of music have no value added, and that's a huge problem. I owned the CD at one time for many of my downloads, there is NO way in hell I am paying twice--that's just good business sense
I think the problem will never go away until people feel a sense of economic security. No one will buy music if they believe they may be out of work and unable to find a new job for a long period of time. So, even if the artists have their way to stop piracy, I don't think it would add much to the bottom line. So I think the music industry would be better served by getting the government to focus on economics and social structures that work.
Taxation is the price we pay for failing to build a civilized society. The higher the tax level, the greater the failure. A centrally planned totalitarian state represents a complete defeat for the civilized world, while a totally voluntary society represents its ultimate success. --Mark Skousen

I’d also like to be able to claim money back for the (more common) moments of suffering.
Intellectual copyright is a complex issue and my opinion isn't fixed. Until recently I considered it acceptable to take a fresh free copy of an album one had bought on vinyl years ago, but no longer owned. Now, especially if that recording is being sold by the artists themselves, I feel that one should buy a copy again. Another fuzzy case is where something might be banned or difficult to obtain like Gary Glitter. An issue mentioned by Gauche.
Music is tricky as it leaks and there is the advertising aspect.
Artists no doubt get a tough deal in the music business, but that’s true for employees in most businesses.
I guess that my general opinion is that if only consenting adults are involved, it is probably ok. I also agree with Cpt_p that the main idea is that artists should get due compensation. Twentieth Century Fox should also. Working out a fair price is another matter.
I’d be unhappy if software I’d taken years to write was copied for free and used by every Tom, Dick and Harriet.
there is a good documentary on music and intellectual property called "rip a remix manifesto" that can be found on hulu.com. http://www.hulu.com/search?query=RiP!+A+Remix+Manifesto&st=1. the first time i even knew this was a big deal was when i read an article on some citizens of some Scandinavian country protesting I.P laws, and how it shouldn't exist. and one of them had a pirate bay flag.

Yes, yes and yes.
Would you be alright with Bill Clinton violating copyright law? I ask because he has done so on television quite a bunch of times.
Of course nobody made a big deal about those felonies. After all, that was long thin stuff going in his mouth. They were still felonies.

Oh, BTW, yesterday, I went to NYC and Manny's music. If anyone reading this knows a musician, ask them about Manny's. We all know it. Actually, it is now part of Sam Ash but whatever.
Anyway, I paid $490 for a new bass. Because I make music and I know who gets screwed on the deal. Hint: It ain't me getting screwed because I choose not to involve myself with the industry.
I get my kicks by making other people have fun. A couple of local bars like it when I show up because random hot chicks like what I do. They like it enough that eventually they end up buying me drinks.
So random hot chicks like me. Random hot chicks buy me drinks. Random hot chicks give my local bar owner cash. Phil Spector is sucking cock in prison. I hope that he knows that he can get cigarettes for that.
